Welcome to Logbucks.

These Terms of Use ("Terms") constitute an agreement between you and Tech Wagon, operating under the name LogBucks ("Logbucks", "we", "our" or "us").

By creating an account, accessing Logbucks or using our applications, our website or our services, you agree to these Terms.

If you do not accept these Terms, you must not use Logbucks.

1. About Logbucks

Logbucks is a digital platform accessible notably from:

• The website;
• The Android application;
• The iOS application.

Logbucks provides various features allowing users to manage and consult the information and tickets they choose to transmit to the platform as well as to access the features offered by Logbucks.

The features available may evolve over time.

2. Creating an account

To create a Logbucks account, we only request:

• Your first name;
• Your email address.

You must provide accurate information and not intentionally use the identity or email address of another person.

You are responsible for protecting your account access information.

If you believe your account has been compromised or used without authorization, you must contact us as soon as possible.

3. Use of the service

You agree to use Logbucks in accordance with:

• These Terms;
• Applicable laws;
• The rules of the platforms used to access Logbucks.

You must notably not:

• Use Logbucks for illegal purposes;
• Attempt to access Logbucks systems without authorization;
• Circumvent security mechanisms;
• Knowingly introduce malicious software;
• Disrupt the operation of the service;
• Use the service to attack, overload or compromise our infrastructure;
• Attempt to access another user's account;
• Use Logbucks to infringe the rights of others.

4. User-provided content

You may transmit to Logbucks tickets, information, texts or other content as part of the use of the service.

You remain responsible for the content you provide.

You must have the necessary rights to transmit such information to Logbucks and to allow us to process it in order to provide the requested features.

You must not knowingly transmit content that is:

• Illegal;
• Fraudulent;
• Malicious;
• Infringing the rights of a third party;
• Containing information that you do not have the right to communicate.

Logbucks does not acquire ownership of your content simply because you use it in the service.

You grant us only the rights necessary to host, store, process, display and use such content in order to provide and maintain Logbucks features.

5. Location

Some Logbucks features may use your device's location.

Location is optional.

When you authorize this feature, we may use your location to present nearby results or features.

Logbucks does not record your precise location in your account and does not retain it for this purpose.

You can refuse or withdraw location authorization from your device.

6. Notifications and communications

Logbucks may send you push notifications and emails necessary for the operation of the service.

You can disable push notifications from your device settings.

For communications to which an unsubscribe mechanism is applicable, you can use the "unsubscribe" function provided in emails or the settings available in the application.

Some communications necessary for the operation of the account may continue to be sent.

7. Subscriptions

Some Logbucks features may be offered as part of a paid subscription.

The applicable pricing conditions are presented before subscribing.

Billing terms may vary depending on the platform used.

Website

Payments made on the website may be processed by Stripe.

Android

Subscriptions made via Android may be managed by Google Play Billing.

iOS

Subscriptions made via iOS may be managed by Apple's App Store payment system.

Logbucks does not retain the complete information of the bank cards used for these payments.

8. Renewal and cancellation

When your subscription is automatically renewable, the renewal and cancellation terms are displayed at the time of subscription and also depend on the platform used.

For purchases made through a third-party platform such as Google Play or the App Store, cancellation may need to be made directly in the settings of that platform.

Deleting the application does not necessarily mean automatic cancellation of a subscription.

9. Pricing

The applicable prices are those displayed at the time of subscription, subject to applicable taxes and the rules of the platform used.

We may change our prices or offers in the future.

When required, price changes applicable to existing subscriptions will be communicated in accordance with applicable laws and rules.

10. Service availability

We make reasonable efforts to keep Logbucks available and reliable.

Our infrastructure is designed with multiple redundancy, replication and backup mechanisms.

We aim for an API availability of 99.99%.

This value constitutes an availability objective and not an absolute guarantee.

The service may be temporarily unavailable notably due to:

• Maintenance;
• An update;
• A technical incident;
• A third-party provider outage;
• A network issue;
• A cyberattack;
• An event beyond our control.

11. Security

We implement technical and organizational measures intended to protect the data processed by Logbucks.

These measures notably include, depending on the systems concerned:

• AES-256 encryption of data at rest;
• Backups;
• Off-site backups;
• Multiple replicas of certain services;
• Access control mechanisms;
• Service continuity measures.

No IT infrastructure can guarantee absolute security.

12. Confidentiality

The use of your personal information is described in our Privacy Policy.

The Privacy Policy is an integral part of your use of Logbucks.

It notably describes:

• The information we collect;
• How we use it;
• Payment information;
• Cookies and Google Analytics;
• Notifications;
• Security;
• Your rights;
• The deletion of your data.

13. Intellectual property

Logbucks and its associated elements, including software, design, brand, logos, interfaces, texts and graphic elements, are protected by applicable laws.

Unless otherwise indicated, these elements belong to LogBucks or are used under license.

These Terms do not grant you any ownership rights in Logbucks.

We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use Logbucks in accordance with these Terms.

14. Feedback and suggestions

If you voluntarily provide us with feedback, suggestions or ideas regarding Logbucks, you authorize us to use them to improve the service, without obligation of remuneration, unless otherwise agreed in writing.

15. Third-party services and links

Logbucks may use or integrate services provided by third parties.

These services may notably include payment, hosting, analytics, email sending or notification services.

Third-party services may be subject to their own terms and policies.

We do not necessarily control third-party services and are not responsible for changes, interruptions or independent practices of these providers.

16. Suspension or termination

We may suspend or terminate an account when reasonably necessary, notably in case of:

• Violation of these Terms;
• Fraudulent activity;
• Abusive use;
• Attack or attempted attack against our systems;
• Legal obligation;
• Risk to the security of Logbucks or its users.

When reasonably possible and appropriate, we may inform the user before a suspension or termination.

17. Deletion of your account

You may request the deletion of your account and data in accordance with our Privacy Policy.

Some information may be temporarily retained when its retention is necessary to comply with a legal obligation, resolve a dispute, prevent fraud or abuse, ensure security or comply with normal backup procedures.

18. Absence of absolute warranty

To the extent permitted by applicable law, Logbucks is provided on an "as is" and "as available" basis.

We do not warrant that:

• The service will be available without interruption;
• All features will be permanently available;
• The service will be free of any error;
• All results will always be accurate;
• The service will be compatible with all devices or configurations;
• Third-party services will operate without interruption.

We nevertheless strive to maintain a reliable, secure and available service.

19. Limitation of liability

To the extent permitted by applicable law, Tech Wagon shall not be liable for indirect, incidental, special or consequential damages resulting from the use of or inability to use Logbucks.

Nothing in these Terms is intended to exclude or limit liability that cannot be legally excluded or limited in the applicable jurisdiction.

20. Indemnification

To the extent permitted by applicable law, you agree not to use Logbucks in a manner that causes damage to Logbucks, its users or its partners.

Where permitted by applicable law, you may be liable for the consequences resulting from illegal, fraudulent or abusive use of the service or from a willful violation of these Terms.

21. Changes to the Terms

We may modify these Terms to take into account:

• The evolution of Logbucks;
• New features;
• Technical changes;
• Legal or regulatory changes;
• Changes in our services or partners.

The date of last update is indicated at the bottom of this page.

When required by law, we will provide appropriate notice regarding significant changes.

22. Applicable law

These Terms are governed by the laws of Ontario, Canada, subject to the mandatory consumer protection rules and other provisions that may apply to your place of residence.

Nothing in these Terms is intended to deprive you of the mandatory rights granted to you by the applicable laws of your jurisdiction.
